Terms of Service
The terms governing use of the DermaGenome enterprise platform, APIs, and white-label deployments.
Acceptance of Terms
By accessing or integrating with the DermaGenome platform, APIs, SDKs, or white-label deployments, you agree to these Terms of Service on behalf of the contracting organization. If you are accepting on behalf of an entity, you represent that you have authority to bind that entity.
Enterprise License & Scope of Use
DermaGenome grants enterprise customers a limited, non-exclusive, non-transferable license to access and integrate the platform for their internal business purposes and for the purposes described in the executed order. White-label deployments are permitted only under an enterprise agreement that expressly authorizes embedded use. Skin intelligence outputs are provided for skincare guidance and wellness use cases, not for medical diagnosis or treatment.
API Usage & Rate Limits
Access to DermaGenome APIs is governed by scoped credentials, documented rate limits, and the API terms in your agreement. Customers must keep credentials confidential, implement reasonable access controls, and not attempt to reverse-engineer, resell, or sub-license access outside the agreed scope. Usage is monitored and metered per the agreement.
Customer Responsibilities
Customers are responsible for the accuracy of data submitted, the security of their integration, end-user consents where applicable, and compliance with laws relevant to their use, including data-protection obligations for any personal or health data they process through the platform.
Acceptable Use
Customers may not use the platform to process data unlawfully, to build competing skin-intelligence services, to misrepresent DermaGenome outputs as medical diagnoses, or to attempt to disrupt or overload the service. DermaGenome may suspend access for material violations after notice where feasible.
Intellectual Property
DermaGenome retains all rights to the platform, models, documentation, and underlying technology. Customer data and derivative outputs created for the customer remain the customer’s. No rights are granted except as expressly stated in these Terms or the executed agreement.
Fees & Billing
Enterprise fees, term, and payment terms are defined in the executed order. Unless stated otherwise, fees are non-refundable. Taxes are the customer’s responsibility where applicable. Overages beyond included usage are billed per the agreement.
Term & Termination
These Terms run for the agreement term and continue unless terminated. Either party may terminate for material breach following written notice and a cure period. Upon termination, access ends and each party returns or deletes the other’s confidential data as specified in the agreement and the Data Processing Addendum.
Disclaimers
The platform is provided “as is” for skincare intelligence and wellness guidance. DermaGenome does not provide medical advice, diagnosis, or treatment, and outputs should not be relied upon as a substitute for professional medical judgment. DermaGenome disclaims warranties to the extent permitted by law.
Limitation of Liability
To the extent permitted by law, DermaGenome’s aggregate liability is limited to the amounts paid in the twelve months preceding the event, as further defined in the executed agreement. Neither party is liable for indirect or consequential damages except as required by law or for breaches of confidentiality.
Governing Law & Changes
These Terms are governed by the laws specified in the executed agreement. DermaGenome may update these Terms for prospective use; material changes are communicated to enterprise contacts in advance. The last-reviewed date below reflects the most recent review.
